The All Progressives Congress (APC) has expressed reservations about Governor Siminalayi Fubara’s 2024 budget presentation, specifically targeting four out of the 31 members of the Rivers State House of Assembly. The budget, amounting to N800 billion, was presented to the selected lawmakers presumed to be loyal to the governor shortly after the demolition of the House of Assembly Complex in Port Harcourt.

Mr. Tony Okocha, the Chairman of the state APC Caretaker Committee, asserted in a statement in Port Harcourt that this action was unconstitutional. He cited Section 120(2) of the Constitution, emphasizing that no money should be spent unless appropriated by the state House of Assembly.
“The presentation of a bill to 4 suspended members of the House of Assembly does not fulfill the requirements of the constitution for all the reasons stated,” Okocha declared.
Highlighting the potential consequences, Okocha cautioned that any expenditure made by the state government based on such a presentation would constitute a clear infringement on the constitution, providing sufficient grounds for impeachment.

Furthermore, Okocha pointed to Section 92(2)C, which stipulates that a Speaker can be removed by a two-thirds majority of the House of Assembly. He contended that there was no evidence to support the removal of Mr. Martins Amaewhule, the current Speaker of the House.
“Amaewhule remains the speaker of the House of Assembly; the lawmakers passed a vote of confidence on him,” Okocha affirmed. This critique by the APC underscores concerns about the constitutional adherence in the budget presentation process and raises questions about the political dynamics within the Rivers State Assembly.
